Refusals & litigation
We review the decision and record to assess the legal options that may be available.
How we can help
- Assessment of reconsideration
- Appeals, where a right exists
- Federal Court judicial review
Does this sound like you?
- You received a refusal and need to understand the reasons and possible options before submitting another application.
- You want to assess whether reconsideration, an available appeal or judicial review should be considered.
- A decision affects your status or plans and you need to identify the relevant dates urgently.
What we review in a consultation
- Cyrus can compare the decision with the material submitted and distinguish evidence concerns from possible legal or procedural issues.
- The consultation can consider available routes, their differences and the limits on introducing new information in each process.
- It can address the scope of potential representation; sending an enquiry does not mean the firm has agreed to act.
Getting ready for the first step
Have this information to hand. A short summary is enough for your first message; we will explain how to share documents securely.
- State the decision date and when you were notified; share the decision only after receiving secure submission instructions.
- Identify the forms, documents and explanations included in the application, together with any correspondence received.
- Note stated deadlines, steps already taken and previous representatives; flag any scheduled hearing or departure immediately.
Questions about this service
Can you review a refusal while I am still in Argentina?
Yes. Martina can arrange a remote consultation with Cyrus. State when you received the decision and any deadline; keep the notification and a copy of what was submitted. We will explain how to share the file securely. Being in Argentina is not a reason to delay checking a Canadian deadline.
Is reapplying the same as appealing?
No. A new application seeks another decision; an appeal, where that right exists, challenges a decision through a designated process. Judicial review has a different function and procedure.
Does the Federal Court approve the application directly?
Judicial review examines legal issues concerning the decision and requires the Court's permission. A favourable outcome may lead to a fresh assessment without guaranteeing approval of the immigration application.
Does contacting you pause a deadline?
No. Contacting us, waiting for a response or asking for reconsideration should not be treated as stopping a deadline. Provide the dates promptly and seek urgent assistance if a deadline is approaching.
